Terms of Service

These Terms of Service ("Terms") govern access to and use of the Forge platform ("Service"), a hosted infrastructure-provisioning service (PostgreSQL, Redis, object storage, container apps, and related tooling) operated by [BEESWORX LEGAL NAME] (Reg. No. [BEESWORX REGISTRATION NO.]), a company registered in South Africa with its registered address at [BEESWORX REGISTERED ADDRESS] ("Beesworx", "we", "us"). By creating an account or using the Service you agree to these Terms.
1. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa. The parties submit to the non-exclusive jurisdiction of the South African courts, subject to [BEESWORX PREFERRED FORUM / ARBITRATION CLAUSE, ATTORNEY TO ADVISE].
2. The Service
Beesworx provisions and operates backing infrastructure (databases, caches, object storage, container hosting, authentication, feature flags, an LLM gateway, and related tooling) on your behalf. You retain control of, and responsibility for, the applications and data you deploy ("Customer Content").
3. Accounts and organizations
- You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account and API keys.
- An organization ("org") is the billing and access-control boundary. Org owners and admins assign a role (owner, admin, member, or viewer) when inviting a member; each role grants a fixed permission level (read, deploy, or admin; owner and admin currently carry the same permission level).
- Self-serve signup may require e-mail verification and may be gated by captcha and other anti-abuse checks before an account is activated.
4. Acceptable use
Use of the Service is subject to the Acceptable Use Policy and, for e-mail sent through the Service, the Anti-Spam Policy. Both are incorporated into these Terms by reference. A breach of either is a breach of these Terms and may result in suspension or termination as described in the Acceptable Use Policy.
5. Fees, billing, and non-payment
- Fees are billed as described at signup or in your order form or plan, through our billing provider (RevEx; see the sub-operator list).
- Non-payment. Your account becomes past due when a subscription payment fails or lapses unpaid, or when an invoice (including a usage invoice) remains unpaid more than three days after it is issued. We will notify the org's owners and, where the platform requires a payment method to deploy, new compute may be refused until one is on file. If the account remains past due for [14] days after we first notify you, we suspend the account under the suspension ladder in the Acceptable Use Policy. Suspension does not delete your data. Deletion for non-payment is not automatic: an operator must act, or, only where automatic deletion has been separately enabled for the platform, deletion follows a further period after suspension. The platform's automated pre-deletion warning goes to Beesworx, not to you; any notice to you before deletion is sent by us directly [OWNER TO CONFIRM WHETHER AUTOMATIC DELETION FOR NON-PAYMENT IS ENABLED ON FORGESERVER.APP, THE PERIOD, AND HOW CUSTOMERS ARE NOTIFIED BEFORE DELETION].
- Fees are exclusive of VAT and other applicable taxes unless stated otherwise.
6. Customer Content and data
- You retain all rights to Customer Content. You are responsible for the legality of Customer Content and for your own compliance obligations (including POPIA, where you are a responsible party; see the Data Processing Agreement).
- We do not access or use Customer Content except (a) to provide, secure, and support the Service, (b) as required by law, or (c) as you direct (e.g. support tickets you open).
- Backups: where scheduled backups are enabled, we take a daily encrypted backup of each PostgreSQL database, each dedicated Redis instance and each managed MariaDB database; object storage and non-dedicated Redis are not backed up this way. 7. Suspension and termination
We may suspend or terminate the Service for a given account as described in the Acceptable Use Policy's suspension ladder (warn, suspend, then delete after a notice period), including for: acceptable-use violations, non-payment, a legal or regulatory demand, or a risk to the security or availability of the platform or other tenants. Suspension takes the account's web applications offline (a reversible 503 page on each application hostname), stops its application containers, dedicated Redis instances and managed MariaDB databases, and blocks the org's members from its dashboard and API, without deleting data. Shared PostgreSQL databases and their credentials, object storage, SFTP, and any directly exposed ports remain reachable during a suspension. Deletion follows the process in the Acceptable Use Policy.
You may terminate by contacting [SUPPORT CONTACT]. There is no self-service "delete my account" action today: an owner or admin can download a data export from the organization page before requesting termination, and the operator carries out the deletion. See the Data Processing Agreement for what a deletion covers and what the export does not include.
8. Service levels, availability, and disclaimers
The Service is provided "as is" and "as available". Forge does not guarantee uninterrupted or error-free operation. To the maximum extent permitted by South African law, we disclaim all implied warranties. [SLA COMMITMENTS, IF ANY, ATTORNEY/PRODUCT TO ADVISE].
9. Limitation of liability
To the maximum extent permitted by law, Beesworx's aggregate liability arising out of or related to the Service is limited to the fees paid by you in the [3/6/12] months preceding the claim. Neither party is liable for indirect, incidental, special, or consequential damages. 10. Data protection
Where you process personal information of third parties (e.g. your users' data) using the Service, you are the "responsible party" and Beesworx acts as your "operator" under the Protection of Personal Information Act 4 of 2013 ("POPIA"). See the Data Processing Agreement for the terms governing that processing, and the Privacy Policy for what Beesworx itself collects as the Service operator.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified via the dashboard or e-mail. Continued use after a change takes effect constitutes acceptance.
